Acceptable Use Policy

Effective: [To be confirmed] Last updated: September 14, 2026 (Draft v1.0 — for legal review) Version: 1.0

Draft for business/legal review. Not legal advice. Requires review by qualified Indian counsel before publication or execution.

Developer Note: Draft for lawyer review. Not legal advice. Must be read with Terms, Privacy Policy and TRAI TCCCPR/DLT requirements.

1. Introduction

This Acceptable Use Policy (“AUP”) supplements the Terms of Service. It governs all use of Agilis voice, SMS, WhatsApp, SIP, API and business software Services. Violations may lead to investigation, throttling, filtering, suspension or termination per Terms Section 20, and may trigger provider or regulatory blocking (e.g., header/template blacklisting per TRAI directions).

2. Prohibited Uses — General

  • Fraud, cheating, personation, phishing, impersonation, spoofing (including CLI spoofing), forgery, or use of telecom identifiers/networks for fraudulent or security-incident purposes (per Telecom Cyber Security Rules, 2024).
  • Spam, unsolicited commercial communications (UCC) without consent/preference compliance, harassment, stalking, or unlawful robocalling.
  • Illegal content, harassment, hate, or traffic intended to evade provider controls or threaten network stability.
  • Unauthorized access, reverse engineering where prohibited, or attempts to bypass rate limits, auth or compliance controls.

3. Telecom-Specific Abuse

Without consent and proper DLT/PE/header/template registration and scrubbing, you must not:

  • Send promotional traffic on transactional 1600/160x routes or mix promotional content into transactional/service messages.
  • Use auto-dialer/robocall for promotional voice on non-140-series numbering; for promotional auto-dialer you must pre-declare use to the Originating Access Provider (OAP) and respect preference scrubbing.
  • Register content templates in wrong category, link one template to multiple headers, or use un-whitelisted URLs/APKs/OTT/callback numbers (TRAI direction Sep 1 2024 onward).
  • Initiate campaigns that cause provider suspension, route blocking, or header/template blacklisting (e.g., 5 templates blacklisted for wrong category → OAP suspension for 1 month per TRAI Aug 2024 direction).
  • Abuse SIP/trunking, high-frequency API calls beyond TPS, or traffic designed to evade DLT scrubbing/chain validation (PE→TM chain must be defined and match or messages are rejected from Nov 1 2024).

5. Security & Account Integrity

  • Protect API keys/credentials, rotate regularly, restrict to authorized users; promptly notify compromise.
  • Do not share or re-use provider credentials to circumvent DLT blocks or use a different provider to evade a blacklist.
  • Maintain accurate sender/chain information for traceability (PE→TM chain per Feb 2023 direction).

6. Enforcement & Suspension

We may monitor, filter, throttle, or suspend traffic/accounts/Channels where we reasonably believe AUP, law, or provider/regulatory requirements are violated. Immediate suspension may occur for urgent fraud/security/regulatory/network-protection situations (e.g., misuse of headers/templates → immediate suspension until FIR/complaint and corrective measures per TRAI Aug 2024 direction). Notice-based suspension applies for other violations with opportunity to cure where practicable. Repeated UCC/UTM violations may lead to telecom resource disconnection and blacklisting communicated across all providers.

7. Reporting & Cooperation

Report abuse to abuse@agiliscommunications.com and privacy@agiliscommunications.com. You must cooperate with investigations, provide consent evidence, and file complaints/FIRs with law enforcement as required by TRAI directions for header/template misuse (within 2 business days for delivery telemarketers or OAP files). We may share incident data with providers/regulators as required by law.
